Adjustment of Status and Consular Process
Adjustment of status is a process where an eligible foreign national may obtain legal permanent status in the United States while in the U.S. While consular process is an alternate process for those outside of the U.S In most cases, a petition must be filed on the foreign national’s behalf. The two main types of petitions are called the I-130 Alien Relative Petition and the I-140 Immigrant Petition for Alien Worker. There may be a wait time while a visa becomes available depending on the category the petition is filed under. Generally, this information is available in the Department of States’ website under Visa Bulletin and is updated on a monthly basis.
